Terms and Conditions of Sale
ARTICLE 1
These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by La Sablésienne with non-professional buyers wishing to purchase products offered for sale on the website www.sablesienne.com. These conditions apply to the exclusion of all other conditions, particularly those applicable to in-store sales or sales through other distribution and marketing channels. These General Terms and Conditions of Sale are accessible at any time on this website and shall prevail, where applicable, over any other version or contradictory document.
Unless proven otherwise, the data recorded by La Sablésienne constitutes proof of all transactions. The products presented on this website www.sablesienne.com are offered for sale in the following territories and countries: metropolitan France and Monaco. Product offers are valid while stocks last. Information on product availability is provided at the time the order is placed. Modifications to these General Terms and Conditions of Sale are enforceable against website users from the moment they are posted online and cannot apply to transactions concluded previously. The Buyer's order confirmation constitutes unreserved acceptance of these General Terms and Conditions of Sale.
ARTICLE 2 - Orders
It is the Buyer's responsibility, as an adult, to select the products they wish to order on the website, according to the following terms. The Buyer adds all chosen items to their cart. The Buyer can, at any time, add, modify or delete products. They can also abandon their cart. When the Buyer has finished their purchases, they click on "Complete my order" to proceed to the order summary and then to payment. The sale will be considered final once payment has been accepted by La Sablésienne. In the event of order cancellation by the Client after this payment, for any reason whatsoever except force majeure, the sum paid upon order, as defined in the "Payment Conditions" article of these General Terms and Conditions of Sale, shall be automatically acquired by the Seller and cannot give rise to any refund. La Sablésienne reserves the right to refuse an order if the Client already has a dispute with La Sablésienne or if La Sablésienne believes that the Client poses a risk of payment default. La Sablésienne then reserves the right to request additional information from its Client if it deems it necessary, such as proof of identity or address. Without a response from the Client within 5 days following the order, the order and payment are cancelled. La Sablésienne undertakes to fulfill orders received, only within the limits of available stock. All orders outside the Eurozone will be subject to validation by La Sablésienne.
ARTICLE 3 - Prices
Products are supplied at the current prices listed on the website at the time of order registration. Prices are expressed in Euros, all taxes included for the Eurozone. These prices are firm and non-revisable during their period of validity, as indicated on the La Sablésienne website. They do not include any potential shipping costs.
ARTICLE 4 - Payment Conditions
The Client pays on the La Sablésienne website by bank card from Visa, Mastercard, Maestro and American Express networks via the secure payment platform by Mercanet. The price is payable in full, in its entirety on the day the order is placed.
To guarantee the Buyer a fully secure transaction, La Sablésienne has chosen the "Mercanet" solution from BNP. With this system, payment by bank card is made directly on La Sablésienne's bank's secure server. At no time will the Buyer's card number be communicated to La Sablésienne as exchanges are encrypted. The Seller will not be obliged to deliver the ordered products if the Buyer does not pay the full price under the conditions indicated above. Bank card payments are debited at the time of order confirmation.
Furthermore, the Seller reserves the right, in case of non-compliance with the payment conditions listed above, to suspend or cancel the delivery of current orders placed by the Buyer.
ARTICLE 5 - Delivery
Products purchased by the Buyer will be delivered in metropolitan France and Monaco within two to four working days, to the address indicated by the Buyer when placing their order on the website. Except in specific cases or unavailability of one or more products, ordered products will be delivered in a single shipment. Deliveries are handled by an independent carrier.
The Client has the choice between several delivery methods: Colissimo relay point, Colissimo home delivery without signature, Chronopost home delivery.
Outside the European Union, customs or import taxes may be added to the price of our products and remain the responsibility of the Client. It is therefore the Client's responsibility to inquire about their amount with their local customs office.
Shipping costs are borne by the Client and vary depending on the destination. The Client has the choice between several delivery methods, whose costs and deadlines vary:

Delivery times are the sole responsibility of the carriers, and in no case can La Sablésienne be held responsible for non-compliance with delivery times.
La Sablésienne undertakes to make its best efforts to deliver the products ordered by the Buyer within the deadlines specified above. However, these deadlines are provided for informational purposes only, and any potential delay cannot give rise to any damages, withholding, or cancellation of the order by the Buyer.
In the event of a special request from the Buyer concerning the packaging or transport conditions of the ordered products, duly accepted in writing by the Seller, the related costs will be subject to specific additional invoicing, based on a quote previously accepted in writing by the Buyer.
The Buyer is obliged to check the condition of the delivered products. They have a period of 7 days from delivery to make any reservations or claims in writing (postal mail) for non-conformity or apparent defect of the delivered products, with all relevant supporting documents. After this period and failing to comply with these formalities, the products will be deemed compliant and free from any apparent defect, and no claim can be validly accepted by the Seller.
The Seller will replace as soon as possible and at its own expense, the delivered products whose apparent defects or non-conformities have been duly proven by the Buyer.
ARTICLE 6 - Transfer of ownership, transfer of risks
The transfer of ownership of La Sablésienne's products and the corresponding transfer of risks of loss and deterioration related thereto, will be effected upon acceptance of the order by La Sablésienne, materializing the agreement of the parties on the item and the price, regardless of the date of payment and delivery. The products therefore travel at the Buyer's risk, who may, in case of damage, make all claims to the carrier under the legal and regulatory conditions in force.
ARTICLE 7 - Right of withdrawal
In accordance with the provisions of Article L 121-20 of the Consumer Code, the Buyer has a withdrawal period of 7 working days from the delivery of the products to inform the seller of their wish to return and to request a refund without penalty, with the exception of shipping and return costs. This request must be sent to La Sablésienne, by email to the following address: contact@sablesienne.com, specifying the customer number, order number, the products and corresponding quantities the Buyer wishes to return (with their best-before date) and the reasons for return.
In all cases, the goods must be returned intact, not expired, in their original packaging. The Buyer must imperatively attach a copy of the return request email to the package. The return package must be sent back to La Sablésienne by Colissimo with signature required.
After receiving this package, La Sablésienne will refund the Buyer within 30 days the amount corresponding to the returned products, with the exception of shipping and return costs which remain the responsibility of the Buyer.
ARTICLE 8 - Seller's responsibility
The products sold on www.sablesienne.com are described and presented with the greatest accuracy. However, product presentation may be altered by the Buyer's computer screen, and La Sablésienne cannot contractually guarantee them.
La Sablésienne is bound only by an obligation of means concerning the operation and continuity of the internet service. La Sablésienne therefore cannot be held responsible for inconveniences and damages resulting from the use of the Internet network, such as an interruption in service continuity, the presence of computer viruses or external intrusions or, more generally, any case qualified as force majeure by French courts.
The La Sablésienne website may offer the Buyer hypertext links to other sites. La Sablésienne would not be bound by any commitment concerning any other site to which the Buyer may thus have access and therefore cannot be held responsible for the content, operation, and access to these sites.
La Sablésienne company cannot be held liable to third parties for indirect damages, special damages or incidents arising from negligence, failure or clumsiness of the Client, or resulting from improper use by the Client of any of the products offered for sale on the ablesienne.com website.
Finally, La Sablésienne's liability is limited to the amount of the Client's order.
The products sold on the www.sablesienne.com website are subject to the legal guarantee of conformity set out in Articles L.217-4 et seq. of the Consumer Code and to the guarantee against hidden defects set out in Articles 1641 et seq. of the Civil Code.
1) Legal guarantee of conformity
Article L. 217-4 of the Consumer Code: The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. They are also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was carried out under their responsibility or was their contractual obligation. Article L. 217-5 of the Consumer Code: The goods conform to the contract: 1° If they are fit for the purpose ordinarily expected of similar goods and, where applicable: - if they correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model; - if they present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or their representative, particularly in advertising or labeling; 2° Or if they present the characteristics defined by mutual agreement between the parties or are fit for any special purpose sought by the buyer, brought to the seller's attention and accepted by the latter. Article L. 217-12 of the Consumer Code: The action resulting from a lack of conformity is time-barred after two years from the delivery of the goods.
1) Guarantee against defects of the sold item
Article 1641 of the Civil Code: The Seller is bound by a warranty against hidden defects in the sold item that render it unfit for its intended use, or that diminish this use to such an extent that the buyer would not have acquired it, or would have paid a lower price for it, had they known of them. Article 1648 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.
When acting under the legal guarantee of conformity, the Client:
- benefits from a period of two years from the delivery of the goods to act;
- can choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code;
- is exempt from proving the existence of the lack of conformity of the goods during the twenty-four months following the delivery of the goods.
The legal guarantee of conformity applies independently of any commercial warranty that may have been granted.
The Client may decide to implement the guarantee against hidden defects of the sold item within the meaning of Article 1641 of the Civil Code and, in this case, may choose between rescission of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.
ARTICLE 10 - Privacy Policy
All personal data communicated by the Client on the www.sablésienne.com website are subject to computer processing intended for the processing and delivery of orders. This data is exclusively reserved for La Sablésienne.
In accordance with the amended "Data Protection Act" no. 78-17 of January 6, 1978, the processing of the Client's personal data is subject to a declaration to the CNIL (French Data Protection Authority), and the Client has a right to access, modify, rectify, and delete data concerning them by contacting La Sablésienne, avenue Jean Monnet, contact@sablesienne.com
The Client can subscribe to La Sablésienne's newsletter and thus choose to be regularly informed of offers. They have, at any time, the possibility to unsubscribe by clicking on the link provided for this purpose in each newsletter.
ARTICLE 11 - Intellectual Property
The content of the site is the property of the Seller and its partners and is protected by French and international intellectual property laws. Any total or partial reproduction of this content is strictly prohibited and may constitute an act of counterfeiting.
ARTICLE 12 - Applicable Law, Language
These General Terms and Conditions of Sale are governed by and subject to French law.
ARTICLE 13 - Disputes
In the event of a dispute, an amicable solution will be sought primarily before any legal action. To this end, La Sablésienne thanks the Buyer for contacting its customer service at La Sablésienne 1 avenue Jean Monnet, contact@sablesienne.com
Failing an amicable solution, any legal action will be brought before the competent courts. These provisions do not deprive customers domiciled outside France of the application of rules provided for in international conventions.
ARTICLE 14 - Buyer's Acceptance
The act of a natural person (or legal entity) ordering on the Seller's website implies full and unreserved adherence to and acceptance of these General Terms and Conditions of Sale, which is expressly acknowledged by the Buyer who, by doing so, waives the right to invoke any contradictory document that would be unenforceable against the Seller.
