ARTICLE 1
These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by La Sablésienne, to non-professional buyers, wishing to acquire the products offered for sale on the website www.sablesienne.com. These conditions apply to the exclusion of all other conditions, and in particular those applicable to sales in stores or by means of other distribution and marketing channels. These General Terms and Conditions of Sale are accessible at all times on this website and shall prevail, where applicable, over any other version or any other contradictory document.

Unless proven otherwise, the data recorded by La Sablésienne constitutes proof of all transactions. The products presented on this website www.sablesienne.com are offered for sale in the following territories and countries: France métropolitaine and Monaco. Product offers are subject to availability. Information on product availability is provided at the time the order is placed. Modifications to these General Terms and Conditions of Sale are enforceable against users of the site as from the date they are put online and cannot be applied to transactions concluded previously. Validation of the order by the Buyer implies unreserved acceptance of these General Terms and Conditions of Sale.
ARTICLE 2 - Orders
It is the responsibility of the Buyer, a person of legal age, to select on the site the products he/she wishes to order, in accordance with the following terms and conditions. The Buyer adds all selected items to his/her shopping cart. The Buyer may add, modify or delete products at any time. He may also abandon his basket. When the Buyer has completed his/her purchases, he/she clicks on "Complete my order" in order to proceed to the settlement of his/her order and payment. The sale will be considered final once payment has been accepted by La Sablanca. In the event of cancellation of the order by the Customer after such payment has been made, for any reason whatsoever other than force majeure, the amount paid for the order, as defined in article "Terms of Payment" of these General Terms and Conditions of Sale, shall be automatically acquired by the Vendor and shall not give rise to any reimbursement whatsoever. La Sablésienne reserves the right to refuse an order if the Customer already has a dispute with La Sablésienne or if La Sablésienne considers that the Customer involves a risk of payment default. In such a case, La Sablésienne reserves the right to request additional information from the Customer if it deems this necessary, such as proof of identity or address. If no reply is received from the Customer within 5 days of the order being placed, the order and payment will be cancelled. La Sablésienne undertakes to honor all orders received, subject to availability. All orders outside the Euros zone will be subject to La Sablésienne's validation.
ARTICLE 3 - Prices
Products are supplied at the current prices shown on the site when the order is placed. Prices are expressed in Euros, all taxes included for the Euros zone. These prices are firm and non-transferable during their period of validity, as indicated on the La Sablésienne website. They do not include any transportation costs.
ARTICLE 4 - Terms of payment
The Customer pays on the La Sablésienne website by credit card from the Visa, Mastercard, Maestro and American Express networks via the payment platform secured by Mercanet. The price is payable in cash, in full, on the day the order is placed.
In order to guarantee the Buyer a fully secure transaction, La Sablésienne has chosen BNP's "Mercanet" solution. With this system, credit card payments are made directly to the secure server of La Sablésienne's bank. At no time will the Buyer's credit card number be communicated to La Sablésienne, as the exchanges are encrypted. The Seller will not be obliged to deliver the products ordered by the Buyer if the Buyer does not pay the Seller the full price in accordance with the above conditions. Payments by credit card are debited at the time the order is validated.

In addition, the Seller reserves the right, in the event of non-compliance with the terms of payment set out above, to suspend or cancel delivery of orders in progress made by the Buyer.
ARTICLE 5 - Delivery
Products purchased by the Buyer will be delivered in France and Monaco within two to four working days to the address indicated by the Buyer when placing his/her order on the website. Except in special cases or when one or more products are unavailable, the products ordered will be delivered at once. Deliveries are made by an independent carrier.
The Customer can choose between several delivery methods: Colissimo point relais, Colissimo envois à domicile sans signature , Chronopost à domicile.
Outside the European Union, customs or import taxes may be added to the price of our products and remain the responsibility of the Customer. It is therefore the customer's responsibility to check with his local customs office to determine the amount of these taxes.
Please note that shipping costs are not refundable
Postage costs are the responsibility of the Customer and vary according to the destination. The Customer has a choice of several delivery methods, whose costs and delays vary:

Delivery deadlines are the sole responsibility of the carriers and under no circumstances can La Sablésienne be held liable for failure to meet delivery deadlines.
La Sablésienne undertakes to use its best efforts to deliver the products ordered by the Buyer within the time limits specified above. However, these deadlines are communicated by way of indication and any delay shall not give rise to any damages, withholding or cancellation of the order by the Buyer.
In the event of a particular request by the Buyer, the Buyer shall be entitled to cancel the order

The Buyer is responsible for verifying the condition of the products delivered. The Buyer has a period of 7 days from the date of delivery to lodge any complaints or claims for non-conformity or apparent defects of the products delivered, by post, with all relevant supporting documents. Once this time has elapsed and these formalities have been complied with, the products will be returned in conformity and free of any apparent defect, and no claim will be validly accepted by the Vendor.

The Vendor will replace, as soon as possible and at his own expense, any products delivered which have been proven by the Buyer to be defective in appearance or not in conformity.
ARTICLE 6 - Transfer of ownership, transfer of risk
The transfer of ownership of La Sablésienne's products and the corresponding transfer of the risks of loss and deterioration relating thereto, shall be carried out in accordance with the terms of the contract between La Sablésienne and the Buyer;alis; dès acceptance of the order by La Sablésienne, matérialisant the agreement of the parties on the thing and on the price and this whatever the date of the payment and of the delivery. Products therefore travel at the Buyer's risk, and the Buyer may, in the event of damage, make any claims to the carrier in accordance with the legal and regulatory conditions in force.

ARTICLE 7 - Right of return The Buyer has, in accordance with the provisions of article L 121-20 of the French Consumer Code, a right of withdrawal of 7 working days from the delivery of the products in order to cancel the contract; as of delivery of the products, the customer may inform the seller of his or her wish to return the products and request reimbursement without penalty, with the exception of shipping and return costs. This request must be addressed to La Sablésienne, by e-mail to the following address: contact@sablesienne.com, specifying the customer number, the order number, the products and corresponding quantities that the Buyer wishes to return (with their use-by date) and the reasons for the return. In all cases, the goods must be returned intact, undamaged and in their original packaging. The Buyer must enclose a copy of the return request e-mail with the package. After receipt of this parcel, La Sablésienne will reimburse the Buyer within 30 days for the sum corresponding to the products returned, with the exception of shipping and return costs, which remain the Buyer's responsibility. ARTICLE 8 - Seller's liability The products sold on www.sablesienne.com are described and presented with the utmost accuracy. However, the presentation of the products may be altered by the Buyer's computer screen and La Sablésienne cannot contractually guarantee them. La Sablésienne is only bound by an obligation of means with regard to the operation and continuity of the service on the internet. La Sablésienne may not be held liable for any inconvenience or damage resulting from the use of the Internet network, such as a break in the continuity of the service, the lack of access to the site, or any other inconvenience; of the service, the presence of computer viruses or external intrusions or, more generally, all cases qualified as force majeure by the French courts. customer's negligence, carelessness or clumsiness, or resulting from misuse by the Customer of any of the products offered for sale on the ablesienne. com website.com. Finally, La Sablésienne's liability is limited to the amount of the Customer's order. The products sold on the www.sablesienne.com website are subject to the legal warranty of conformity provided by articles L.217-4 et seq. of the French Consumer Code, and to the warranty against hidden defects provided by articles 1641 et seq. of the French Civil Code. 1

When acting under the legal warranty of conformity, the Customer: - has a period of two years from the date of delivery of the goods to take action; - may choose between repair or replacement of the good, subject to the conditions of cost set out in article L.217-9 of the Consumer Code; - is exempted from proving the existence of the defect of conformity of the good during the twenty-four months following the delivery of the good. The legal warranty of conformity applies independently of any commercial warranty. The Customer may decide to invoke the warranty against latent defects in the item sold, as defined in article 1641 of the French Civil Code, and may in this case choose between rescission of the sale or a reduction in the sale price, in accordance with article 1644 of the French Civil Code. ARTICLE 10 - Respect for privacy All data of a personal nature communicated by the Customer on the www.sablésienne.com website is subject to computer processing for the purpose of processing and delivering orders. These data are exclusively used by La Sablésienne. ARTICLE 13 - Disputes In the event of a dispute, an amicable solution will be sought as a priority before any legal action.
