General terms and conditions of sale
These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by La Sablésienne with non-professional buyers wishing to purchase the products offered for sale on the www.sablesienne.com website. These conditions apply to the exclusion of all other conditions, in particular those applicable to in-store sales or sales via other distribution and marketing channels. These General Terms and Conditions of Sale are accessible at all times on this Internet site and shall prevail, where applicable, over any other version or any other contradictory document.
In the absence of proof to the contrary, the data recorded by La Sablésienne constitutes proof of all transactions. The products presented on the www.sablesienne.com website are offered for sale in the following territories and countries: Metropolitan France and Monaco. Product offers are subject to availability. Information on product availability is provided when the order is placed. Modifications to these General Terms and Conditions of Sale are enforceable against users of the site from the time they are put online and cannot be applied to transactions concluded previously. Validation of the order by the Buyer implies unreserved acceptance of these General Terms and Conditions of Sale.
ARTICLE 2 - Orders
It is the responsibility of the Buyer, who is of legal age, to select the products they wish to order on the site, in accordance with the following procedures. The Buyer adds all the selected items to his/her basket. The Buyer may add, modify or delete products at any time. They may also abandon their basket. When the Buyer has finished shopping, he/she clicks on "Complete my order" in order to proceed to the summary of his/her order and then to payment. The sale will be considered final once payment has been accepted by La Sablésienne. In the event of cancellation of the order by the Customer after this payment, for any reason whatsoever other than force majeure, the sum paid at the time of the order, as defined in the article "Terms of payment" of these General Terms and Conditions of Sale, will be automatically acquired by the Seller and may not give rise to any reimbursement whatsoever. La Sablésienne reserves the right to refuse an order if the Customer already has a dispute with La Sablésienne or if La Sablésienne considers that the Customer involves a risk of non-payment. La Sablésienne then reserves the right to ask its Customer for additional information if it deems it necessary, such as proof of identity or proof of address. If there is no response from the Customer within 5 days of the order being placed, the order and payment will be cancelled. La Sablésienne undertakes to honour orders received only within the limits of available stocks. All orders outside the Euro zone will be subject to validation by La Sablésienne.
ARTICLE 3 - Rates
Products are supplied at the current prices shown on the site when the order is placed. Prices are expressed in Euros, all taxes included for the Euros zone. These prices are firm and non-revisable during their period of validity, as indicated on the La Sablésienne website. They do not include any transport costs.
ARTICLE 4 - Terms of payment
The Customer pays on the La Sablésienne website by credit card from the Visa, Mastercard, Maestro and American Express networks via the Mercanet secure payment platform. The price is payable in cash, in full, on the day the order is placed.
In order to guarantee the Purchaser a completely secure transaction, La Sablésienne has chosen the BNP "Mercanet" solution. With this system, payment by bank card is made directly to the secure server of La Sablésienne's bank. At no time will the Buyer's card number be communicated to La Sablésienne as the exchanges are encrypted. The Seller will not be obliged to deliver the products ordered by the Buyer if the latter does not pay the price in full in accordance with the conditions indicated above. Payments by bank card are debited at the time the order is validated.
In addition, the Seller reserves the right, in the event of non-compliance with the payment conditions set out above, to suspend or cancel the delivery of orders in progress placed by the Buyer.
ARTICLE 5 - Delivery
Products purchased by the Buyer will be delivered in mainland France and Monaco within two to four working days, to the address indicated by the Buyer when placing the order on the website. Except in special cases or when one or more products are unavailable, the products ordered will be delivered in a single shipment. Deliveries are made by an independent carrier.
All orders placed before 5 p.m. will be dispatched the following day, except for orders placed on Saturdays and Sundays, which will be dispatched the following Tuesday, and orders placed on public holidays, which will be dispatched the following working day.
The Customer can choose between several delivery methods: Colissimo point relais, Colissimo home delivery without signature, Chronopost home delivery.
Outside the European Union, customs or import taxes may be added to the price of our products and are payable by the Customer. It is therefore the Customer's responsibility to find out the amount of these taxes from their local customs office.
Delivery charges are payable by the Customer and vary according to the destination. The Customer can choose between several delivery methods, the costs and times of which vary:

Delivery times are the sole responsibility of the carriers and La Sablésienne cannot be held responsible in the event of delivery times not being respected.
La Sablésienne undertakes to make its best efforts to deliver the products ordered by the Purchaser within the time limits specified above. However, these deadlines are communicated by way of indication and a possible overrun may not give rise to any damages, withholding or cancellation of the order by the Purchaser.
In the event of a specific request from the Buyer concerning the conditions of packaging or transport of the products ordered, duly accepted in writing by the Seller, the related costs will be subject to specific additional invoicing, based on a quotation previously accepted in writing by the Buyer.
The Buyer is responsible for checking the condition of the products delivered. The Buyer has 7 days from the date of delivery in which to express any reservations or complaints in writing (by post) regarding the non-conformity or apparent defects of the products delivered, together with all the relevant supporting documents. Once this period has elapsed and if these formalities have not been complied with, the products will be deemed to be in conformity and free from any apparent defect and no claim will be validly accepted by the Vendor.
The Vendor will replace, as soon as possible and at its own expense, any products delivered for which apparent defects or lack of conformity have been duly proven by the Buyer.
ARTICLE 6 - Transfer of ownership, transfer of risks
The transfer of ownership of the products from La Sablésienne and the correlative transfer of the risks of loss and deterioration relating thereto, will take place upon acceptance of the order by La Sablésienne, materialising the agreement of the parties on the item and on the price, regardless of the date of payment and delivery. The products therefore travel at the risk and peril of the Purchaser who may, in the event of damage, make all claims to the carrier under the legal and regulatory conditions in force
ARTICLE 7 - Right of withdrawal
The Buyer has, in accordance with the provisions of Article L 121-20 of the Consumer Code, a withdrawal period of 7 working days from delivery of the products to inform the seller of his wish to return and to request reimbursement without penalty, with the exception of shipping and return costs. This request must be sent to La Sablésienne, by e-mail to the following address: contact@sablesienne.com, specifying the customer number, the order number, the products and corresponding quantities that the Buyer wishes to return (with their use-by date) and the reasons for the return.
In all cases, the goods must be returned intact, unexpired and in their original packaging. The Purchaser must imperatively attach to the parcel a copy of the return request e-mail. The return package must be sent back to La Sablésienne by Colissimo against signature.
After receipt of this parcel, La Sablésienne will reimburse the Purchaser within 30 days the sum corresponding to the returned products, with the exception of the shipping and return costs, which remain the responsibility of the Purchase
ARTICLE 8 - Seller's liability
The products sold on www.sablesienne.com are described and presented as accurately as possible. However, the presentation of the products may be altered by the Buyer's computer screen and La Sablésienne cannot contractually guarantee them.
La Sablésienne is only bound by an obligation of means with regard to the operation and continuity of the Internet service. La Sablésienne cannot therefore be held responsible for any inconvenience or damage resulting from the use of the Internet network, such as a break in the continuity of the service, the presence of computer viruses or external intrusions or, more generally, any case qualified as force majeure by the French courts.
La Sablésienne's Internet site may offer the Purchaser hypertext links to other sites. La Sablésienne shall not be bound by any commitment concerning any other site to which the Buyer may thus have access and shall therefore not be responsible for the content, operation and access to these sites.
La Sablésienne shall not be liable to third parties in the event of indirect damage, special damage or incidents resulting from negligence, failure or clumsiness on the part of the Customer, or resulting from misuse by the Customer of any of the products offered for sale on the ablesienne.com site.
Finally, La Sablésienne's liability is limited to the amount of the Customer's order.
ARTICLE 9: Legal guarantee
The products sold on the www.sablesienne.com website are subject to the legal guarantee of conformity set out in articles L.217-4 et seq. of the French Consumer Code and the guarantee against hidden defects set out in articles 1641 et seq. of the French Civil Code.
1) Legal guarantee of conformity
Article L. 217-4 of the French Consumer Code: The seller shall deliver goods in conformity with the contract and shall be liable for any lack of conformity at the time of delivery. He shall also be liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter was his responsibility under the contract or was carried out under his responsibility. Article L. 217-5 of the French Consumer Code: The goods conform to the contract: 1° If they are fit for the purpose normally expected of similar goods and, where applicable : - if it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model; - if it has the qualities that a buyer may legitimately expect given the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling; 2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter. Article L. 217-12 of the French Consumer Code: Any action resulting from a lack of conformity shall be barred after two years from the date of delivery of the goods.
1) Warranty for defects in the item sold
Article 1641 of the French Civil Code: The Vendor is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair that use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he been aware of them. Article 1648 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
When acting under the legal guarantee of conformity, the Customer :
- has a period of two years from the date of delivery of the property in which to take action;
- may choose between repairing or replacing the good, subject to the cost conditions set out in Article L.217-9 of the French Consumer Code ;
- is exempted from proving the existence of the lack of conformity of the goods during the twenty-four months following delivery of the goods.
The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.
The Customer may decide to invoke the guarantee against latent defects in the item sold within the meaning of Article 1641 of the French Civil Code, and may in this case choose between rescission of the sale or a reduction in the sale price in accordance with Article 1644 of the French Civil Code.
ARTICLE 10 - Respect for privacy
All personal data communicated by the Customer on the site www.sablésienne.com is subject to computer processing intended for the processing and delivery of orders. This data is exclusively reserved for La Sablésienne.
In accordance with the French Data Protection Act no. 78-17 of 6 January 1978, as amended, the processing of the Customer's personal data is subject to a declaration to the CNIL and the Customer has the right to access, modify, rectify and delete data concerning him/her by contacting La Sablésienne, avenue Jean Monnet, contact@sablesienne.com.
The Customer may subscribe to the La Sablésienne newsletter and thus choose to be regularly informed of the offers proposed. They may unsubscribe at any time by clicking on the link provided for this purpose on each newsletter.
ARTICLE 11 - Intellectual property
The content of the site is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property. Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.
ARTICLE 12 - Applicable law, language
These General Terms and Conditions of Sale are governed by and subject to French law.
ARTICLE 13 - Litigation
In the event of a dispute, an amicable solution will be sought as a priority before any legal action. To this end, La Sablésienne would ask the Buyer to contact its customer service department at La Sablésienne 1 avenue Jean Monnet, contact@sablesienne.com
In the absence of an amicable solution, any legal action will be brought before the competent courts. These provisions do not deprive customers domiciled outside France of the application of the rules laid down in international agreements.
ARTICLE 14 - Acceptance by the Buyer
The fact that a natural person (or legal entity) places an order on the Vendor's Internet site implies full and unreserved acceptance of these General Terms and Conditions of Sale, which is expressly recognised by the Buyer, who thereby waives the right to rely on any contradictory document, which would be unenforceable against the Vendor.
